Terms
1) Eligibility (17+)
The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
2) The Service
Swavinara is a platform for exploring and sharing authentic recipes with friends and family. You can discover recipes from people you trust, follow friends, save recipes to revisit, and share your own recipes with step-by-step instructions, ingredient lists, and photos. Community features may allow likes, comments, and other interactions.
3) Accounts
You may need an account to use some features. You agree to provide accurate information (such as name, username, and email) and keep it up to date. You are responsible for activities under your account and for maintaining the confidentiality of your login credentials.
4) Your Content
"User Content" means content you submit or create through the Service, such as recipes, ingredient lists, cooking steps, notes, photos, comments, and other materials.
You retain ownership of your User Content. You grant Swavinara a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display your User Content solely to operate, provide, and improve the Service, including customer support and backups. This license ends when you delete the relevant User Content from the Service, except as necessary for backups, legal obligations, or security purposes.
You are responsible for ensuring you have the rights to upload or submit any User Content you provide.
5) Acceptable Use
You agree not to:
- Use the Service in a way that violates applicable laws or regulations.
- Infringe, violate, or misappropriate intellectual property, privacy, or other rights.
- Upload unlawful, harmful, deceptive, or abusive content (including harassment, hate, or threats).
- Post content that you do not have the right to share.
- Attempt to bypass, disable, or interfere with security-related features.
- Reverse engineer or attempt to discover source code, except where permitted by law.
- Use automated means to access the Service in a manner that could harm or degrade the Service.
We may remove content or restrict access if we reasonably believe it violates these Terms or is necessary to protect the Service, users, or our rights.
6) Food Safety and Recipe Disclaimer
Recipes and other content on Swavinara are provided for general informational purposes. Cooking involves inherent risks (including allergies, foodborne illness, burns, and other hazards). You are responsible for using appropriate judgment, verifying ingredient safety and allergen information, and following safe food handling and cooking practices.
7) Privacy
Our collection and use of personal information are described in our privacy practices. By using the Service, you acknowledge that you have read and understand how we process personal information to operate and improve the Service.
This page intentionally does not include links to other agreement pages because they may be hosted on different paths or domains.
8) Intellectual Property
The Service (including its software, design, and content provided by Swavinara) is owned by Swavinara or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted to you, no rights are granted.
9) License to You
Subject to these Terms, Swavinara grants you a limited, personal, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use.
10) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWAVINARA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SWAVINARA DOES NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWAVINARA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.
To the maximum extent permitted by law, Swavinara's total liability for any claim will not exceed the amount you paid to Swavinara for the Service in the 12 months before the event giving rise to the claim, or USD $50 if you have not paid any amounts, whichever is greater.
12) Indemnification
You agree to indemnify and hold harmless Swavinara from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.
13) Termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or if necessary to protect the Service, users, or our rights.
Upon termination, the license granted to you ends. Sections that by their nature should survive will survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution).
14) Changes to the Service or These Terms
We may change the Service from time to time and update these Terms. If we make material changes, we will update the effective date and, where appropriate, provide notice in the app. Continued use after changes become effective means you accept the updated Terms.
15) Governing Law
These Terms are governed by the laws of the jurisdiction of our principal place of business, without regard to conflict-of-laws rules.
16) Binding Arbitration and Class Action Waiver
Except where prohibited by law, disputes arising out of or relating to these Terms or the Service will be resolved by binding arbitration, not in court.
- The arbitration will be conducted by a single arbitrator.
- The arbitration will be conducted in English.
- The seat (legal place) of arbitration will be the jurisdiction of our principal place of business, unless we agree otherwise.
- The arbitrator may award relief only on an individual basis.
CLASS ACTION WAIVER: YOU AND SWAVINARA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
17) Apple App Store Additional Terms
- These Terms are between you and Swavinara, not Apple.
- Apple has no obligation to provide maintenance or support services for the app.
- If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price (if any) for the app.
- Apple is not responsible for addressing claims relating to the app, including product liability, legal compliance, or consumer protection claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18) Miscellaneous
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later.
